Terms of Service

These Terms of Service ("Terms") govern access to and use of viraltalent.co and its related pages, forms, and content (collectively, the "Site"). The Site is operated by Viral Talent LLC ("Viral Talent," "we," "us," or "our").

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Viral Talent is a creator and influencer marketing agency. The Site provides general information about our services, work, and process and allows prospective clients to submit campaign inquiries and subscribe to communications.

Site content is informational. It is not an offer, promise, or guarantee of particular services, creator availability, audience reach, revenue, return on advertising spend, conversions, or any other result.

You must be at least 18 and legally capable of entering a binding agreement to use the Site. If you use the Site for a company or another organization, you represent that you have authority to act for that organization and that “you” includes that organization.

Submitting an inquiry does not create an agency-client, partnership, fiduciary, or exclusive relationship and does not reserve creators or guarantee acceptance, a response time, or a proposal.

A campaign or other engagement begins only after Viral Talent and the client enter a separate written agreement accepted by authorized representatives. That agreement will control if it conflicts with these Terms regarding the engagement.

Do not submit confidential or proprietary information through the Site unless we have separately agreed in writing to receive it confidentially. Information submitted before such an agreement is not subject to a confidentiality obligation except as required by our Privacy Policy or applicable law.

You agree not to:

• use the Site in violation of law or another person's rights;
• submit information that is false, misleading, fraudulent, defamatory, infringing, unlawful, or harmful;
• impersonate another person or misrepresent your authority;
• gain or attempt to gain unauthorized access to systems, accounts, or data;
• probe, scan, disrupt, overload, damage, scrape, or interfere with the Site or its security;
• introduce malware, malicious code, or abusive automated traffic;
• bypass rate limits, anti-spam controls, or access restrictions; or
• reproduce, distribute, or commercially exploit Site content except as these Terms or applicable law allow.

We may restrict access when we reasonably believe use violates these Terms or threatens the Site, Viral Talent, or others.

You retain ownership of information you submit. You grant Viral Talent a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and use that information only as reasonably necessary to operate the Site, respond to your request, protect the Site, comply with law, and pursue a potential or existing business relationship.

You represent that you have the rights and permissions needed to provide the information and that our permitted use will not violate another person's rights or a contractual restriction.

The Site, including its design, code, text, graphics, animation, video, audio, photographs, logos, trademarks, and other content, is owned by Viral Talent or its licensors and is protected by intellectual-property and other laws.

Subject to these Terms, Viral Talent grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful business-information purposes. No other rights are granted. Viral Talent's name, logo, and branding may not be used without prior written permission. Third-party names, logos, and marks remain the property of their respective owners.

Case studies, testimonials, client or partner logos, campaign metrics, and examples describe particular experiences. They are not guarantees of future performance. Results vary with the brand, creator, product, audience, market, content, budget, timing, platform, and other factors.

If you submit an inquiry, you authorize us to contact you about that request using the details you provide. If you separately subscribe to marketing communications, you may unsubscribe at any time through the link in an email. Unsubscribing from marketing does not prevent communications needed to respond to an inquiry or administer an existing relationship.

Our Privacy Policy explains how we handle personal information and is incorporated into these Terms by reference. Please review it before submitting information through the Site.

The Site may rely on or link to third-party services, platforms, or websites. We do not control and are not responsible for third-party content, terms, availability, security, or privacy practices. A link or integration does not necessarily imply endorsement. Your use of a third-party service is governed by its own terms and policies.

We may modify, suspend, or discontinue any part of the Site at any time. We do not promise that the Site will always be available, uninterrupted, secure, accurate, or error-free. We may correct errors and update content without notice.

To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available.” Viral Talent disclaims express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment.

We do not warrant that the Site will be uninterrupted, secure, or free from errors or harmful components, or that content will be complete, current, or suitable for your purposes. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

To the maximum extent permitted by law, Viral Talent and its members, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from the Site or these Terms.

Viral Talent's aggregate liability arising from the Site will not exceed the amount, if any, you paid specifically to use the Site during the six months before the event giving rise to the claim. These limits do not exclude liability that cannot lawfully be excluded. A separate client agreement may set different terms for paid services.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Viral Talent and its members, officers, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Site, violation of these Terms, information you submit, or violation of another person's rights. The scope and enforceability of this provision remain subject to final legal review.

Viral Talent's governing-law, venue, and dispute-resolution terms will be specified after legal review and before final publication. No jurisdiction or arbitration requirement is selected by this draft. Nothing in these Terms limits mandatory consumer rights that apply in your place of residence.

You may stop using the Site at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created legal exposure, or threatened the operation or security of the Site. Provisions that by their nature should survive will survive, including those concerning intellectual property, disclaimers, liability, and disputes.

We may revise these Terms. We will post the updated version here and update the effective date. Changes apply prospectively unless stated otherwise or applicable law requires additional notice or consent. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.

These Terms and the Privacy Policy are the entire agreement concerning use of the Site, except that a separate written agreement controls the services it covers. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. Headings are for convenience only.
